General Terms and Conditions of Sale applicable to enrolments for courses offered by the UFM. These GCS are expressly approved and accepted by the Student, who declares and acknowledges that he/she is fully aware of them, and therefore waives the right to rely on any contradictory document.
• Article 1 - Scope of application
These General Terms and Conditions of Sale, hereinafter referred to as the "GTCS", are entered into between :
The association Science pour demain, a non-profit association under the French law of 1901 registered under the number RNA W771005809, whose registered office is located at 7 les queurses, 77320 Choisy-en-brie, France, hereinafter referred to as UFM (brand name) and represented by Frank HATEM in his capacity as president, duly authorised for the purposes hereof.
And between any natural person or legal entity, private individual or professional, under private or public law wishing to engage in one or more services provided by the UFM, hereinafter referred to as the Student.
• Article 2 - Purpose
The purpose of the GCS is to define the terms and conditions of sale between the MRU and the Student, from the time of the online order until the end of the course. They are an integral part of the contract between the Student and UFM. They are fully enforceable against the Student who has accepted them by validating his/her order.
The UFM reserves the right to amend these terms and conditions at any time by publishing a new version on its website. The GTC applicable at that time are those in force on the date of payment (or of the first payment in the case of multiple payments) of the order. The UFM also ensures that their acceptance is clear and unreserved by setting up a checkbox and a validation click when ordering. Acceptance of the GTCS also implies acceptance of the association's internal regulations, which can be consulted on request. The students' internal rules can also be consulted online here:

Acceptance validated by the act of payment in accordance with the information described on the order form and in these conditions.
The Student declares that he/she is legally capable of entering into a contract under French law or that he/she validly represents the natural person or legal entity on whose behalf he/she is entering into a contract.
In the absence of proof to the contrary, the information recorded by the Association constitutes proof of all transactions.
• Article 3 - Services
The services governed by these GCS are those which appear on the website and which are indicated as sold. The services are described and presented as accurately as possible. Photographs are not contractually binding.
• Article 4 - Prices
All prices are quoted inclusive of VAT and in euros, and do not include annual membership of the association and therefore do not include access to the training platform for more than 15 days. The UFM reserves the right to change its prices at any time.
• Article 5 - The order
When placing an order, the Student must fill in his/her contact details, payment details and finally accept the Terms and Conditions, this last step formalising the service contract between the UFM and the Student.
The UFM will acknowledge receipt of the order as soon as it has been validated by sending an e-mail. The contract will then be concluded on the date and time of the acknowledgement of receipt of the order. A subsequent e-mail will specify how to access the training platform in order to download its modules.
• Article 6 - Payment terms
Payment is due when the order is placed. Payment for online services is made by credit card (Carte Bleue, Visa, Mastercard, American Express) or by Paypal, via the Thrivecart payment platform. It is possible to pay in 1 or 3 instalments. Full details are on the Thrivecart order form.
Credit card payments are made via a secure system specific to the platform, such that the information transmitted is encrypted by software.
• Article 7 - Right of withdrawal
The right of withdrawal does not apply to the purchase of online courses or training (you waive your right of withdrawal for digital content provided on an intangible medium whose performance has begun with your agreement (www.service-public.fr).
On 23 June 2011, the European Parliament approved by a large majority the proposal for a Directive of the European Parliament and of the Council on consumer rights. The purpose of this directive is to harmonise consumer protection standards across all Member States. In Chapter III, relating to distance selling and therefore e-commerce, this directive considers that goods derived from digital content cannot entitle a consumer to a right of withdrawal. Digital content includes computer programs, applications, games, music, videos or texts accessible via streaming or downloading from a hardware medium or any other medium. In the final analysis, the sale is deemed to have been concluded from the time the download begins. (In this case, when the Student accesses the UFM platform).
The right of withdrawal may apply if the Student has not accessed the UFM platform within 14 days. The UFM will check the information and it will be possible to make a refund by bank transfer or cheque. The withdrawal request must be sent by e-mail to: contact@ufm-metaphysique.com
• Article 8 - Signature and proof
In all cases, the online provision of the bank card number and the final validation of the order will constitute proof of the completeness of the said order in accordance with the provisions of the law of 13 March 2000 and will constitute payment of the sums incurred by the entry of the Services appearing on the order form.
This validation shall constitute signature and express acceptance of all operations carried out on the website.
• Article 9 - Liability
The MRU undertakes to carry out the Services with the utmost care. However, the UFM cannot be held liable in the event that the non-fulfilment of its obligations is attributable to a case of force majeure as defined by French case law or to a strike. Similarly, the UFM may not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.
• Article 10 - Applicable law and jurisdiction
These GTC are subject to French law. In the event of failure to reach an amicable settlement, any dispute arising from these GCS will be subject to the jurisdiction of the Paris courts.
